This Privacy Policy (“Policy”) describes how LUME Pergolas & Outdoor Living (“LUME,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards information when you visit lumeoutdoorliving.com (the “Site”) or engage with our design, sales, installation, and support services (the “Services”). By using the Site or providing information, you acknowledge this Policy.

We may update this Policy periodically. The “Effective Date” above reflects the latest version. Material changes will be posted here and may be communicated by additional notice where appropriate.

2. Information We Collect

A. Information You Provide.

Identifiers and contact data (name, email, phone, city/ZIP), project scope and property details, photos/files you upload, communication preferences, survey responses, and correspondence (forms, email, SMS, phone).

B. Transaction/Relationship Data.

Quotes, proposals, design selections, permits (where applicable), installation and warranty records, and payment metadata. We do not store full credit/debit card numbers; payments are processed by PCI-compliant processors.

C. Automatically Collected Data.

Device and usage data such as IP address, browser/device type, operating system, language settings, general geolocation (IP-based), pages viewed, time/date stamps, referring/exit URLs, and event metrics (e.g., form starts/completions, clickstream).

D. Cookies, Pixels, and Similar Technologies.

We use first-party and third-party cookies, pixels, tags, and web beacons for essential functionality, analytics, performance, personalization, advertising measurement, and retargeting (e.g., Google Analytics/Ads, Meta, LinkedIn). See §8 for choices.

E. Data From Third Parties.

We may receive limited data from advertising/analytics partners, public sources, referral partners (e.g., architects/builders), and social media platforms to improve marketing accuracy and attribution.

Children. The Site is not intended for children under 13. We do not knowingly collect their data; if learned, we will delete it.

• Provide, operate, and improve the Site and Services (respond to inquiries, schedule consultations, create designs/quotes, coordinate installation, warranty/service support).
• Communicate administrative updates and service notices; send marketing communications if you opt in.
• Personalize content and advertising; measure campaign effectiveness; create look-alike or custom audiences without selling personal data.
• Maintain security, prevent fraud, and comply with legal obligations.
• Conduct analytics, reporting, quality assurance, and staff/vendor training (including AI-assisted triage of form submissions; final decisions are human-directed).

4. SMS/Text & AI-Assisted Contact

If you provide a mobile number and opt in to texts, you consent to receiving SMS related to scheduling, updates, and limited promotions. Message/data rates may apply; frequency varies. Reply STOP to opt out; HELP for help. Mobile opt-in data is not sold or shared with third parties for their own marketing. We may use AI tools to help draft replies to your inquiries; messages and decisions are overseen by our team.

5. How We Share Information

We do not sell personal data. We share only as needed with:

• Service Providers/Processors (hosting, CRM, analytics, advertising platforms, email/SMS vendors, payment processors, installers/subcontractors for your project). They must protect data and use it solely to provide services to LUME.
• Business Transfers (merger, acquisition, financing, or sale of assets).
• Legal/Safety (to comply with law, enforce agreements, protect rights/safety, or respond to lawful requests).

6. Retention

We retain personal information for as long as necessary to fulfill the purposes in this Policy, including providing Services, maintaining records for tax/accounting, resolving disputes, and enforcing agreements. When no longer needed, we delete or de-identify data per our retention schedule.

7. Security

We implement reasonable administrative, technical, and physical safeguards proportional to the nature of the data. No method is 100% secure. You use the Site at your own risk and should notify us of any suspected security incidents.

8. Your Choices: Cookies, Ads, Communications

• Cookie/Tracker Controls: Use browser settings and platform tools to block/delete cookies and manage ad preferences. Blocking non-essential cookies may affect some features.
• Email/SMS Marketing: Click “unsubscribe” in emails; reply STOP to texts.
• Do Not Track: Browser DNT signals are not yet standardized; we do not currently respond to DNT but honor legally required opt-out mechanisms.

9. Your Rights (U.S. State Laws)

Texas (TDPSA): We process personal data consistent with the Texas Data Privacy and Security Act. We do not process sensitive data without consent and do not sell personal data.

California (CCPA/CPRA) & Other States (e.g., CO, CT, VA, UT, OR): Depending on residency and thresholds, you may have rights to know/access, correct, delete, and opt out of certain processing (including targeted advertising or profiling). We will honor valid, verifiable requests.

Requests/Appeals: Email hello@lumeoutdoorliving.com with the subject “Privacy Request.” We will verify your identity and respond within applicable timelines. You may use an authorized agent consistent with law.

10. International Users

Our Services are intended for U.S. customers. If you access from outside the U.S., your data will be processed in the U.S. and subject to U.S. law.

Links/embeds (e.g., maps, videos, social posts) operate under third-party policies. Review their notices before interacting.
